Who is responsible for your personal data?

We, a company associated with the AdNext Group, Mastermind Media Sp. z o. o. with its registered office at Aleje Jerozolimskie 94, 00-807 Warsaw, registered in the District Court for the Capital City of Warsaw, 0000490244th Commercial Division under KRS number 7010406776, NIP 147030330, REGON XNUMX (the “Company”), will be the controller responsible for all personal data that you provide to us in connection with our business relationship.

For what purposes do we use your personal data?

We will only process your personal data for the following purposes (“permissible purposes”):

    • Conducting marketing activities by using the data provided by you for direct marketing of our services and products;

    • Profiling your preferences and interests in order to best match our marketing communications and product and service offerings to your needs. The basis for profiling your preferences and interests is, among others: data provided by you and collected from publicly available sources, which we collect in systems supporting the proper implementation of the services we provide (e.g. in a CRM system), and automatically recorded and stored (including in cookies) data regarding your activity on our websites. The effect of profiling is to provide you with content tailored to your individual interests via our websites, by email, by telephone or on the websites of entities unrelated to us
      that provide us with advertising services (including websites belonging to the Google or Facebook advertising networks).

    • Communicating with you through the channels you have approved in order to receive up-to-date, latest announcements, special offers and other information regarding the services offered by the Company (including through marketing newsletters), as well as information about events and projects;

    • Managing and conducting special events, including customer events and surveys, marketing campaigns, market analysis, sweepstakes, contests or other promotional activities or events;

    • Maintaining the security and protection of our services and websites or other systems, preventing and detecting security threats, fraud and other criminal or malicious activities.

      With respect to marketing communication tools (i.e. e-mails and telephone calls), we will, only where legally permitted, provide you with such information upon your prior consent and will provide you with the opportunity to withdraw your consent if you no longer wish to receive such communications from us in connection with our activities. We will not use your personal data to make any automated decisions about you or create profiles other than those described above. The legal basis for processing your
      personal data is set out in Article 6 of the European General Data Protection Regulation (GDPR). Depending on the permitted purposes for which we use your personal data above, the processing is necessary for the performance of a contract or other business arrangement with us or necessary for the fulfillment of our legal obligations or is necessary for the purposes of our legitimate interests, but always provided that your interests or fundamental rights and freedoms do not override them.       Scope of personal data In particular, we may collect and process the following categories of personal data:

    • Further business-related information necessary for processing within the framework of a project or contractual relationship or information voluntarily provided by you such as applications and projects;

    • Information collected from publicly available sources, such as databases;
    • Where required for compliance with law: information about relevant and important litigation or other legal proceedings against you or a third party related to you, and information about our relationship with you that may be relevant for competition protection purposes.

How do we collect personal data?

We will collect your personal data primarily directly from you. We do not obtain personal data from third parties except for those specified in this document (e.g. information from publicly available sources and databases).

How do we protect your personal data?

We maintain physical, electronic and procedural safeguards in accordance with the latest technical requirements and data protection laws to protect your personal data from unauthorized access or intrusion. These safeguards include the implementation of specific technologies and procedures designed to protect your privacy, such as secure servers, firewalls and SSL encryption. Who will we share your personal data with?

    • With affiliated companies in the AdNext Group, if permitted by law and to the extent necessary to achieve the permitted purposes.     • Service providers (so-called data processors) within or outside the Company, domestically or abroad, e.g. shared service centers, instructed by us to process personal data for permitted purposes on our behalf and solely in accordance with our instructions. The Company will retain control over and remain fully responsible for your personal data and will use appropriate safeguards required by applicable law to ensure the integrity and security of your personal data when we engage such service providers.

    • Any courts, law enforcement agencies, regulatory bodies or legal professionals, where legally permitted and necessary for  compliance with a legal obligation or to establish, bring or defend legal claims.
    • In other cases, we will only disclose your personal data when you instruct us or give us your consent to do so, when we are required to do so by applicable law or regulation or when we receive an official or court order to do so, or when we suspect fraud or criminal
      activity.

Where do we process your personal data?

The Company is an enterprise operating in Poland. In the course of conducting business activities, we do not transfer your personal data to recipients in countries outside the European Economic Area (“third countries”).

Your data protection rights

Subject to certain legal conditions, you have the right to request access to your personal data and to rectify or delete it, as well as to restrict the processing of your personal data. Is provision of personal data required?

As a general rule, you provide personal data completely voluntarily; in principle, refusing consent or sharing personal data does not entail any negative consequences for you. However, in some circumstances, the Company cannot take action without certain personal data because, for example, this personal data is required to provide access to our content or tools, or to conduct legally required compliance checks. In such cases, if you do not provide us with your personal data, we may not be able to provide you with what you have asked us for.

The period of storage of your personal data
